Measure would end no-compete employment contracts for doctors

Florida doctors would no longer be subject to no-compete clauses in their employment contracts under a measure that has been filed for upcoming session.
Rep. Joel Rudman, a physician-lawmaker from Navarre, filed HB 11 on October 5. It faces hearings in the Healthcare Regulation Subcommittee, the Civil Justice Subcommittee, and the Health & Human Services Committee.
A Senate companion has not yet been filed.
The measure would deem any contract that bars a licensed physician from practicing medicine within “a geographic area for any period of time after the termination of a contract, partnership, employment, or professional relationship” an “invalid restrictive covenant” that has “no legitimate business interest.”
Lawmakers in 2019 invalidated no-compete arrangements that prevented certain medical specialists from practicing in underserved and rural areas. HB 11 would expand the measure.
The Legislature convenes a regular 60-day session on January 9, 2024.
